Summary
e paper is an invitation to start a public law oriented discourse about the legal concept of
“constitutional identity”, which is conceived here as the “identity of the constitution”. It is seen
as a part of the constitution, with which the constituent people/nation can identify with as
they created it in the course of constitution-making and constitutional amendment, or which
the constitutional interpretation shaped. It can adequately reect the actual identity of the
constituent people, rooted in the past and overarching the future. Provisions that are entrenched
by eternity clauses and a multi-tier system of constitutional amendments help to locate the
identity of the constitution. is contribution uses the constitutional identity of Hungary as
a model to illustrate how and why constitutional identity could become detrimental, with
some other EU Member States (Germany and Italy, together with the Court of Justice of the
European Union) exemplifying at the same time how the very same constitutional identity can
be used to further unify and consolidate European integration. Based on these trains of thought,
public discourse about the interrelationship and interdependency of constitutional identity (a
non-legal term) and the identity of the constitution (a legal concept) may take place in which
experiences of the Global South should feature. Evidences show that the legally conceptualized
and applied “identity” of a constitution, which is thus basically seen as a Global North —more
specically EU— phenomenon, can be a double-edged sword even in the Global South. Even
if it can contribute to the realization of a legal project, such as the EU, or regional human
rights protection, and to the greatly strengthened protection and involvement of indigenous
and vulnerable peoples in the Global South, in the hands of autocratic and populist leaders and
subservient constitutional courts, it can be abused. is abuse can lead to the dismantling of
regional and national legal achievements by relying on the very same “identity”, which could
quickly be turned into autarchy. If it is not abused, the challenge seems to be the reconciliation
of new and traditional ideas of constitutionalism, the engine of which must be an independent
judiciary.

Este artículo es una invitación para iniciar un discurso orientado al derecho público en torno
al concepto jurídico de “identidad constitucional”, que se concibe aquí como la “identidad

de la constitución”, la cual es vista como una parte de la Constitución con la cual el pueblo/
nación puede identicarse en el proceso de creación y enmienda constitucional así como con
las formas articuladas por la interpretación constitucional. La identidad constitucional puede,
a su vez, reejar adecuadamente la identidad real de las personas constituyentes, encontrando
sus raíces en el pasado y con miras hacia el futuro. Las disposiciones que están arraigadas en las
cláusulas de la eternidad y un sistema de enmiendas constitucionales de varios niveles ayudan
a encontrar la identidad de la constitución. Por ello, esta contribución académica utiliza la
identidad constitucional de Hungría como modelo para ilustrar cómo y por qué la identidad
constitucional podría ser perjudicial; y, también para entender cómo algunos otros Estados
miembros de la UE (Alemania e Italia, junto con el Tribunal de Justicia de la Unión Europea)
ejemplican cómo la misma identidad constitucional se puede utilizar para unicar y consolidar
aún más la integración europea. Con base en estas líneas de análisis, es posible pensar en un
discurso público sobre la interrelación e interdependencia de la identidad constitucional
(término no jurídico) y la identidad de la constitución (concepto jurídico) en el que deben
aparecer las experiencias del Sur Global. Las evidencias muestran que la “identidad” legalmente
conceptualizada y aplicada en una constitución, que básicamente se considera un fenómeno
del Norte Global, más especícamente de la UE, puede ser una espada de doble lo, también
en el Sur Global. A pesar de poder contribuir a la realización de un proyecto legal, como la
UE, o a la protección regional de los derechos humanos, implicando a los pueblos indígenas y
más vulnerables en el Sur Global; la identidad constitucional, fortalecida y en gran medida en
manos de líderes autocráticos y populistas y tribunales constitucionales subordinados, puede
ser objeto de abuso que puede conducir al desmantelamiento de los logros legales regionales y
nacionales al basarse en la misma “identidad”, que rápidamente podría convertirse en autarquía.
Si no se abusa, el desafío parece ser la reconciliación de las ideas nuevas y tradicionales del
constitucionalismo, cuyo motor debe ser un poder judicial independiente.

1. Introduction
e issue of “constitutional identity” is a topic which has already certainly attracted multi-
layered approaches, and which may have similar relevance in contemporary constitutional
democracies as far as constitutional changes are concerned. In this article, I have chosen a legal
approach to studying the “constitutional or national identity”, because, via Article 4.2 of the
Treaty on European Union (from now on TEU), it became a legal phenomenon requiring the
EU not to infringe it. at is why this paper is meant as an invitation to start a public law-
oriented discourse about the legal concept of “constitutional identity”, with the aim of creating
an analytical framework to complement its existing doctrinal and normative views, which
eventually allows us a more compact understanding of formal and informal constitutional
change. For this exercise, we should not disregard the fact that even though legally formulated
and applied constitutional identity seems to be a Global North phenomenon, it oers us the
opportunity to open up a comparative constitutional discussion with the Global South about
its legal designs in international, supranational and constitutional texts.
e comparative analysis, which this paper completes from an admittedly positivist
perspective, is meant to be only a rudimentary experiment which, with further investigations and
