PROBLEMA DE GARANTIZAR LOS DERECHOS HUMANOS

Abstract: The article is devoted to the study of the problem of post-
traumatic stress disorder (PTSD) of combats in the context of the protection
of human rights. Methods used in this research are theoretical and empirical,
with an anonymous survey of 212 participants in the fighting in the East of
Ukraine. Attention is focused on the fact that PTSD is a complex problem,
the negative consequences of which are studied in the framework of
sociology, criminology, and criminal proceedings, as well as psychology,
psychiatry, medicine in general. The article discusses the features of post-
traumatic stress disorder of combats in the east of Ukraine. The conclusions
are formulated on the main social problems of war veterans in Ukraine and
ways to solve them. It has been established that persons who took part in
hostilities in the east of Ukraine have a number of social problems after
returning from the conflict zone, because of which individuals cannot fully
exercise their constitutional rights. A potential “risk group” is defined in the
article among war veterans who are in greater need of social and
governmental patronage. In addition, it formulates specific proposals to
minimize the possible negative consequences of participation in hostilities,

as well as to protect constitutional rights, establish social policies and
support war veterans.

Resumen: Este artículo está dedicado al estudio al trastorno de estrés
postraumático de los participantes en acciones militares, en el contexto de
la protección de los derechos humanos. Los métodos utilizados en esta
investigación son teóricos y empíricos, con una encuesta anónima de 212
participantes en los combates en el este de Ucrania. La atención se centra
en el hecho de que este trastorno es un problema complejo, con
consecuencias negativas en el campo de la sociología, criminología y los
procedimientos penales, tanto como en la psicología, psiquiatría, y la
medicina en general. El estudio se hace cargo de las características de este
trastorno en los militares del este de Ucrania. Las conclusiones se formulan
sobre los principales problemas sociales de los veteranos de guerra y sobre
cómo podrían resolverse. Se ha establecido que las personas que
participaron en hostilidades en el este de Ucrania tienen una serie de
problemas sociales después de regresar de la zona de conflicto, por lo que
se ven impedidas de ejercer plenamente sus derechos constitucionales. En
el artículo se define un potencial “grupo de riesgo” entre los veteranos de
guerra que tienen una mayor necesidad de patrocinio social y
gubernamental. Además, se formulan propuestas específicas para
minimizar las posibles consecuencias negativas de la participación en los
enfrentamientos armados, así como para proteger los derechos
constitucionales, establecer políticas sociales y apoyar a los veteranos de
guerra.
