RESUMEN
En el devenir de la actividad laboral surgen relaciones enmarcadas dentro de la normativa vigente que permiten, de acuerdo al
reconocimiento del Derecho Constitucional, la realización de Convenciones Colectivas en las que participan trabajadores, em-
pleadores y funcionarios públicos. El presente trabajo tiene como nalidad analizar el marco teórico de las convenciones colectivas
y su adaptación a la realidad en Venezuela, tomando las normas constitucionales y legales que rigen al derecho laboral, bajo un
recorrido histórico, empleando enfoques de diversos autores sobre la convención colectiva, intangibilidad de las convenciones,
régimen modicatorio, así como la normativa que rige la materia. La situación problemática se identica por los efectos de las
convenciones en sus diferentes fases, tanto de preparación como de ejecución, al igual que por la autocomposición o conciliación.
Se ha aplicado un tipo de investigación descriptiva, con diseño no experimental, documental. Los resultados de la investigación
evidenciaron que, en Venezuela, en el marco del derecho laboral existe una normativa relacionada con las convenciones colectivas,
a las cuales están sujetos el sector público y el privado, aplicándose esta desde la promulgación de la Ley del Trabajo (1936), sujeto
a las modicaciones que han permitido contar con instrumentos legales acorde con la realidad contemporánea. Por ello, se arma
que la convención colectiva es el instrumento más adecuado para el establecimiento de relaciones de trabajo equilibradas.
ABSTRACT
Dierent relations of the labor activity arise in the existing regulations and these allow, in accordance with the recognition
of the Constitutional Law, the conduction of collective labor agreement in which workers, employers and public ocials
participate. erefore, the aim of this article is to analyze the theoretical framework of the collective labor agreement and its
adaptation to the reality in Venezuela by taking the constitutional and legal norms that govern the Labor Law under a histo-
rical route, using approaches of various authors on the collective agreement, intangible agreement, amending agreement, and
the regulations governing the matter. e problematic situation is identied by the eects of the agreements in their dierent
phases, both in the preparation and in the implementation, as well as in the conciliation. A descriptive, non-experimental,
documentary research design has been applied. e results of the investigation showed that in Venezuela, in the framework of
Labor Law, there is a regulation related to collective agreements to which both the public and private sectors are subjected to,
and this has been applied since the promulgation of the Labor Law (1936), that is subjected to modications that have allowed
the use of legal instruments in regards to the contemporary reality. It is therefore stated that the collective convention is the
most appropriate instrument for the establishment of balanced working relations.
